If you successfully pursue a legal claim for an FCRA violation, you may be entitled to recover actual damages, which can include financial losses you’ve suffered as a result of the inaccurate reporting, as well as damages for emotional distress. In cases where the violation was willful (meaning the credit bureau or furnisher knowingly violated the FCRA or acted in reckless disregard of your rights), you may also be able to recover statutory damages and punitive damages. Additionally, the FCRA and NYFCRA allow for the recovery of reasonable attorney’s fees and costs if you prevail in your lawsuit.
